Companionfy - Terms of Use

1. Acceptance of Terms

By accessing, registering for, or using Companionfy ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, you may not use the Service.

By using the Service, you represent and warrant that:

  • You are at least 18 years old.
  • You have the legal capacity to enter into this agreement.
  • You agree to binding arbitration and waiver of class actions as described below.

2. Description of the Service

Companionfy provides AI-generated virtual companion interactions, including text, voice, and 3D avatar experiences.

You acknowledge and agree that:

  • All interactions are generated by artificial intelligence.
  • No real human is communicating with you through the avatars.
  • AI responses may simulate emotions, including affection, attachment, jealousy, or dominance.
  • The Service is provided for entertainment purposes only.
  • The Service does not provide therapy, counseling, medical advice, or psychological treatment.
  • Companionfy makes no guarantees regarding emotional outcomes or user experiences.

3. Age Restriction

The Service is strictly limited to individuals aged 18 years or older.

We reserve the right to suspend or terminate accounts suspected of being used by minors.

4. User Accounts

You are responsible for:

  • Maintaining confidentiality of your login credentials.
  • All activity under your account.

We may suspend or terminate accounts at our sole discretion, without prior notice.

5. User Conduct

You agree not to:

  • Use the Service for illegal purposes.
  • Harass, threaten, or abuse the system.
  • Attempt to reverse engineer or exploit the AI system.
  • Violate applicable laws or regulations.

Violation may result in immediate account termination.

6. Subscriptions and Payments

Certain features require a paid subscription.

By subscribing, you agree that:

  • Subscriptions automatically renew unless cancelled prior to renewal.
  • Pricing may vary by region and currency.
  • Free trial periods, if offered, convert automatically into paid subscriptions unless cancelled before the trial ends.
  • Payments are processed through third-party providers such as Stripe.
  • All payments are non-refundable except where required by applicable law.
  • You are responsible for managing your subscription and cancellation.

7. AI Disclosure and Emotional Risk Acknowledgment

You understand and acknowledge that:

  • The Service uses artificial intelligence to simulate conversations and emotional responses.
  • The AI may simulate affection, attachment, intimacy, jealousy, or dominance.
  • Any emotional reactions you experience are self-directed.
  • Companionfy is not responsible for emotional distress, dependency, or psychological effects arising from use of the Service.
  • No real romantic, personal, or human relationship exists between you and the AI system.

8. No Warranty

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.

We do not guarantee:

  • Continuous availability.
  • Error-free performance.
  • Specific emotional or personal outcomes.

9. Limitation of Liability

To the maximum extent permitted by law:

  • Companionfy shall not be liable for indirect, incidental, special, consequential, emotional, or psychological damages.
  • We are not liable for emotional distress, mental health impacts, or perceived deception.
  • Our total liability shall not exceed the total amount paid by you in the twelve (12) months preceding the claim.

Some jurisdictions may not allow certain limitations; in such cases, liability is limited to the minimum permitted by law.

10. Indemnification

You agree to indemnify and hold harmless Companionfy from any claims, damages, liabilities, costs, or expenses arising from:

  • Your misuse of the Service.
  • Your violation of these Terms.
  • Your violation of applicable laws.

11. Binding Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively through binding arbitration.

  • Arbitration shall take place in Switzerland.
  • The arbitration shall be conducted in English.
  • The arbitration decision shall be final and binding.
  • You waive the right to litigate disputes in court.

12. Class Action Waiver

You agree that any disputes shall be resolved on an individual basis only.

You waive the right to participate in:

  • Class actions
  • Collective actions
  • Representative proceedings

13. Governing Law

These Terms shall be governed by the laws of Switzerland, without regard to conflict of law principles.

If arbitration is deemed unenforceable, disputes shall be resolved exclusively in Swiss courts.

14. Changes to Terms

We may update these Terms at any time. Continued use of the Service constitutes acceptance of the revised Terms.
